End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User") and IT-MT Development Solutions DOO Pančevo ("Licensor", "we", "us") for the use of the Kuppio Order application ("App").

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

3. License Restrictions

You shall not:

• Copy, modify, or distribute the App or any portion thereof
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Rent, lease, lend, sell, sublicense, or otherwise transfer the App or rights therein to any third party
• Remove, alter, or obscure any proprietary notices in the App
• Use the App for any purpose that violates applicable laws or regulations
• Use the App to develop a competing product or service
• Bypass, disable, or interfere with any security features of the App

4. Intellectual Property Ownership

The App and all copies thereof are proprietary to IT-MT Development Solutions DOO Pančevo and title thereto remains in us. All rights in the App not specifically granted in this EULA are reserved to us. The App is protected by copyright laws of the Republic of Serbia and international treaty provisions.

5. App Permissions

The App may request the following device permissions:

• Location Services: To provide delivery address suggestions and nearby restaurant discovery. You can control location access through your device settings.
• Notifications: To send order status updates, delivery alerts, and promotional messages. You can manage notification preferences within the App or through device settings.
• Camera: To scan QR codes for table sessions or promotions (where applicable).

Offline Limitations: Some features of the App require an active internet connection. Offline functionality is limited to viewing cached content such as saved preferences and order history.

6. Third-Party Services

The App may integrate with or rely on third-party services, including but not limited to payment processors (Stripe, local processors), push notification services (Firebase, APNs), and mapping services (Google Maps). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or performance.

7. Updates & Modifications

We may release updates, patches, or new versions of the App from time to time. Some updates may be required for continued use of the App. We reserve the right to modify, suspend, or discontinue any feature of the App at any time without prior notice.

8. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination:

• You must cease all use of the App
• You must delete all copies of the App from your devices
• Any accrued rights or obligations survive termination

We may also terminate or suspend your access to the App at any time, with or without cause, with or without notice.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will function without interruption or errors, that defects will be corrected, or that the App is free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

Our total aggregate liability under this EULA shall not exceed the amount you paid for the App (if any) or fifty euros (€50), whichever is greater.

11. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• This EULA is between you and IT-MT Development Solutions DOO Pančevo only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• Apple has no warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims relating to the App or your use of the App, including but not limited to product liability claims, consumer protection claims, or intellectual property infringement claims.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

12. Google Play Compliance

If you downloaded the App from Google Play:

• This EULA is between you and IT-MT Development Solutions DOO Pančevo, not Google LLC ("Google").
• Google is not responsible for the App, its content, or any claims arising from the App.
• Your use of the App must comply with Google Play's current Terms of Service.
• Google is a third-party beneficiary of this EULA.

13. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including sanctions administered by the Republic of Serbia, the European Union, and the United States. You may not download or use the App if you are located in a country subject to comprehensive sanctions.

14. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Republic of Serbia. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts in Pančevo, Serbia.
